The American Bar Association House of Delegates, made up of 560 members representing state and local bar associations, ABA entities and ABA affiliated organizations, approved recommendations sponsored by the ABA Commission on Ethics 20/20 that amend the ABA Model Rules of Professional Conduct and commentary. Of special interest for lawyers interested in technology are the House’s Recommendation 105A on lawyers’ use of technology and confidentiality, and 105B on lawyers’ use of technology and client development.

Recommendation 105A advises lawyers on the use of technology and client confidentiality and, as passed, amends: the black letter and comments to Model Rule 1.0 (Terminology); comments to model Rule 1.1 (Competence); comments to Model Rule 1.4 (Communication); the black letter and comments to Model Rule 1.6 (Confidentiality of Information; and the black letter and Comments to Model Rule 4.4 (Respect for Rights of Third Parties).
