On June 18, 2011, the North Carolina House of Representatives passed a bill requiring all employers with 25 or more employees to check the immigration status of their new hires using the E-Verify system. In April 2011, the Indiana House of Representatives had approved a “watered-down” version of Arizona’s HB 1070, containing a provision requiring use of the E-Verify system. In May 2011, the US Supreme Court upheld an Arizona law requiring use of E-Verify, finding that it was not preempted by the Immigration Reform and Control Act, and thus not preempted by the Supremacy Clause of the US Constitution.
